SPLUNO - TERMS AND CONDITIONS

1. Acceptance Of Terms

By downloading, installing, accessing, or using the Spluno mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description Of Service

Spluno is a mobile application that helps users track, organize, and split expenses among friends, family, roommates, and groups. The App allows users to:

• Record and categorize shared expenses
• Calculate how much each person owes or is owed
• Track balances between users
• Facilitate manual settlements between users
• Generate expense reports and summaries

IMPORTANT: Spluno does NOT process payments, handle money transfers, or provide payment gateway services. All financial settlements must be completed manually between users through their preferred payment methods.

3. User Accounts And Registration

• 3.1 Account Creation
  • You must create an account to use certain features of the App
  • You must provide accurate, complete, and current information
  • You are responsible for maintaining the security of your account credentials

• 3.2 Account Responsibility
  • You are solely responsible for all activities under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. User Responsibilities And Conduct

• 4.1 Acceptable Use

  You agree to use the App only for lawful purposes and in accordance with these Terms. You will NOT:

  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to the App or other users' accounts
  • Upload or transmit malicious code, viruses, or harmful content
  • Harass, abuse, or harm other users
  • Use the App to track expenses related to illegal activities

• 4.2 Content Responsibility
  • You are responsible for all content you input into the App
  • You must ensure expense information is accurate to the best of your knowledge
  • You must not input false, misleading, or fraudulent expense information

5. Expense Tracking And Settlements

• 5.1 Expense Recording
  • Users can record expenses and assign them to group members
  • The App calculates balances based on user-inputted information
  • All calculations are estimates based on the data provided by users

• 5.2 Manual Settlements
  • Spluno does NOT facilitate actual money transfers or payments
  • Users must settle debts independently using their preferred payment methods
  • Users can mark expenses as "settled" in the App for record-keeping purposes
  • Spluno is not responsible for ensuring actual payments are made between users

• 5.3 Accuracy Disclaimer
  • Balance calculations are based solely on user-inputted data
  • We do not verify the accuracy of expense information
  • Users are responsible for resolving disputes about expenses among themselves

6. User Responsibilities

• 6.1 Data Collection
  • We collect and use information as described in our Privacy Policy
  • By using the App, you consent to our data practices as outlined in the Privacy Policy
  • We comply with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011

• 6.2 User Data
  • You retain ownership of the expense data you input
  • We may use aggregated, anonymized data for improving our services
  • You can delete your data by deleting your account
  • Sensitive personal data is handled in accordance with Indian data protection regulations

• 6.3 Data Localization
  • We may store and process your data in India or other jurisdictions as permitted by applicable Indian laws
  • Cross-border data transfers, if any, will be conducted in compliance with Indian regulations

7. Intellectual Property

• 7.1 App Ownership
  • Spluno and all related content, features, and functionality are owned by us
  • You are granted a limited, non-exclusive license to use the App
  • You may not copy, modify, distribute, or reverse engineer the App

• 7.2 User Content
  • You retain rights to the content you create using the App
  • You grant us a license to use your content solely for providing the service

8. Disclaimers

• 8.1 Service Availability
  • The App is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue the App at any time

• 8.2 Financial Disclaimer
  • Spluno is NOT a financial service or payment processor
  • We do not provide financial advice or recommendations
  • We are not responsible for any financial losses or disputes between users
  • All financial settlements are the sole responsibility of users

• 8.3 Accuracy Disclaimer
  • We do not guarantee the accuracy of calculations or expense tracking
  • Users should verify all information independently
  • We are not liable for errors in expense calculations or record-keeping

9. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for using the App (if any)
• We are not responsible for disputes between users regarding expenses or settlements
• We are not liable for any financial losses resulting from use of the App

10. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third party's rights
• Any disputes with other users regarding expenses or settlements

11. Modifications To Terms

• We may update these Terms at any time
• Changes will be effective upon posting in the App
• Continued use of the App constitutes acceptance of modified Terms
• We will notify users of significant changes when possible

12. Termination

• 12.1 User Termination
  • You may delete your account and stop using the App at any time
  • Upon termination, your right to use the App ceases immediately

• 12.2 Our Termination Rights

  We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Abuse or harass other users
  • Compromise the security or integrity of the App

13. Dispute Resolution

• 13.1 User Disputes
  • Spluno does not mediate disputes between users regarding expenses
  • Users must resolve financial disputes independently
  • We may provide expense records to help resolve disputes

• 13.2 Legal Disputes
  • These Terms are governed by Indian law
  • Any legal disputes will be resolved through [arbitration/courts] in Nagpur

14. General Provisions

• 14.1 Compliance with Indian Laws:
  • These Terms and your use of the App are subject to Indian laws and regulations.
  • We comply with the Information Technology Act, 2000, Consumer Protection Act, 2019, and other relevant Indian legislation
  • In case of any conflict between these Terms and mandatory provisions of Indian law, Indian law shall prevail

• 14.2 Entire Agreement

  These Terms constitute the entire agreement between you and Spluno regarding use of the App.

• 14.3 Severability

  If any provision of these Terms is found unenforceable under Indian law, the remaining provisions will remain in effect.

• 14.4 Language

  These Terms are provided in English. In case of any translation, the English version shall prevail.
